Accidents and Personal Injury Claims

As a former lawyer representing insurance companies such as Farmers and American Family as well as Geico and the State of Arizona, I know how claims for personal injury damages are handled. I know when an adjuster, or the lawyer for the insurance company, is “lowballing” or being unreasonable. And I know how to fight to get you top dollar.  You are entitled to the full measure of damages the law allows when you are injured by the negligence of another person.

Every personal injury claim requires three things-we must prove: 1) liability, i.e., that the person or entity you are suing was negligent; 2) they caused or contributed to your injury; 3) losses and damages from your injury.

The law sets forth exactly what the negligent party must pay, which includes:

Past and Future medical expenses like hospital, doctor, chiropractic and physical therapy bills and any other necessary medical treatments.

Lost Income from missed work, both past and future income that would have been earned had the injury not occurred.
Loss of Earning Capacity where the injury hurts the injured person’s ability to perform her work now and in the future.

Permanent Injury the cost of care required to make the injured person’s life liveable as before the injury, including long term and special care, like a full time nurse, medical equipment, and modifications to the home and/or car to allow the injured person to live as before the accident.
Pain and Suffering, that is the amount reasonable and necessary to for the physical and emotional pain from the injury—since the injury and until death.

Property Damage meaning the reasonable value of whatever personal property that was damaged or destroyed by the negligence of another.

Every case is different.  Good results depend on getting immediate and comprehensive medical care and making sure a comprehensive demand letter is sent to the wrongdoer and his insurance company. I like to use police reports, accident diagrams, photographs and video showing how the accident happened and how the injury was caused by the negligence of the other party. I obtain all the relevant evidence that can help us, including medical records, surgical reports and photos.
